Terms and Conditions

1. All bookings accepted by us are subject to these terms and conditions.

1.1 The owners reserve the right to vary  these conditions from time to time.

1.2 Our homes are not available for rent to anyone under the age of 30 years of age (i.e. group leader).

1.3 Responsible and respectable behaviour is expected at all times.

2. Booking procedure and payment terms

2.1 Clients are required to complete a booking form and pay a deposit as requested by the owners, by cheque made payable to Dawn Mitchell & Vicky Patterson. Alternatively a US$ deposit may be made by credit card/PayPal subject to a 4% Administration fee.  Alternative arrangements may be made at the discression of the owners. 

2.2 Any provisional booking will be held for up to five working days pending completion of the booking form and receipt of the deposit in respect of the accommodation. A booking will be considered firm when the deposit has been received and we have confirmed the booking in writing via email to the client.

2.3 Payment terms are as follows: 

The full rental cost is due 10 weeks before the date you arrive at the home. A reminder may not be issued. Bookings made within 10 weeks of arrival are payable in full at the time of booking.

2.4 Bookings made less than 4 weeks before departure must be paid by credit card and are subject to a 4% administration fee. 

2.5 Payment of the balance may be made by US$ cheque or alternatively by UK£ cheque . Where the balance due is in US$ but is being paid in UK£ this is subject to the currency exchange rate in force on the day of payment as advertised by Thomascook.com plus payment of a £15 International Money Transfer fee per transaction.

2.6 Payment of the balance may be made in US$ or UK£ by credit or debit card, via PayPal,  subject to a 4% administration charge.

2.7 Due to the high quality of our home and the potential cost of any damage that could be caused, a US$400/ UK£275 refundable security bond is required 4 weeks prior to arrival by cheque.

2.8 A Credit card may be used to provide the security bond but this may be subject to a 4% administration charge (details on request). There is no surcharge for payment of the Security Bond via PayPal

2.9 Security bonds paid by credit card may be refunded in the form of a personal cheque (details on request). Bonds paid using PayPal will be refunded using PayPal.

2.10 Security bonds will be returned within 2 weeks of vacating the property when it has been confirmed that the property and fixtures etc. are in the same condition as when you arrived and that you vacated the property on the correct date / time.

2.11 Directions to the home, the code to the lock box containing the key and alarm code will be made known to you upon receipt of the security bond.

2.12 If you need to change your booking for any reason we will make every effort to accommodate any requests. There is a £30 (US$50) administration fee per week for this service.

3. Cancellation

3.1 The client may cancel the holiday booked at any time after it has been confirmed. Cancellation must be in writing.

3.2 We reserve the right to cancel the holiday if payment has not been received in accordance with clause 2.3 above.

3.3 The following cancellation charges will apply to all rentals cancelled in accordance with clauses 3.1 and 3.2 above.

    More than 60 days prior to departure - loss of deposit

    30 to 60 days - 50% of total rental.

    Within 30 days - 100% of total rental

WE STRONGLY RECOMMEND THAT YOU TAKE OUT HOLIDAY INSURANCE TO COVER UNFORESEEN CIRCUMSTANCES WHICH MAY NECESSITATE CANCELLATION OF YOUR VACATION/HOLIDAY

4. Accommodation

4.1 The accommodation provided is only for the use of persons named by the client on the booking form; subletting, sharing or assigning is prohibited.

4.2 The property will be available to clients after 5p.m. Florida time on the day of arrival unless otherwise agreed. All accommodation must be vacated by 10 a.m. Florida time on the day of departure.

4.3 An adult must accompany persons under the age of 18. At no time must children be left in the property on their own.

4.4 We will not be liable for any losses or injury resulting from the use of the property, equipment, facilities and pool.

4.5 Swimming pools are dangerous and ours is not to be used by children without adult supervision.

4.6 Pool and Spa will be heated to 82-85F but is dependant upon external weather conditions.

4.7 While in normal circumstances you will be accommodated in the home of your choice, we reserve the right to substitute accommodation of a similar or higher standard should this be operationally necessary.

4.8 All breakage’s, accidents or losses to be reported to the Management Company immediately. All breakages and damage must be paid for and will in any case be deducted from the guests security bond. Example charges are available HERE. These are indicative only.

4.9 BBQ's are not allowed for safety reasons.

4.10 Although we will make every effort to ensure that all of the features and facilities within our home are ready for your use, from time to time some features or facilities may not be available. Complimentary free services may be withdrawn by us without notice and alternative services may not be provided.

4.11 Excessive use of Air Conditioning by leaving external doors or windows open will cause excessive bills and we reserve the right to deduct such excessive charges from Security Bonds paid.

4.12 Complimentary free Telephone service includes calls to all landlines throughout the USA, Canada and Europe as defined by the service provider  but specifically excludes calls to mobile numbers and Premium Rate Services. All call charges incurred will be deducted from the clients Security Deposit.

4.13 Security Bonds are retained for up to 28 days pending delivery of electricity and gas bills.

4.14 If you have opted for pool heating then the supplied solar blanket must be used overnight.

Without it the heater will use 2 - 3 times the amount of gas. If you do not use the solar blanket the 'MC' will turn off your pool heat, for the entire stay, and any monies already paid will be forfeited. Similarly gas bills are monitored to ensure this rule is adhered to and guests will be charged any excesses.  

4.15 No liability for consequential loss is accepted by the home owners.

4.16 Whilst every effort will be made to ensure the continuity of all services, no guarantees can be given. Should services be interrupted through no fault of our own, guests will only be compensated up to the value of full 24 hour periods on a pro rata basis. Compensation will only become due once 24 hrs since service interruption have elapsed.
 

5. Check In/Out

5.1 Check In time is from 5pm on the day arrival.

5.2 Check Out time is 10am prompt on the day of departure.

5.3 Trash collection times must be adhered to. A charge will be made for excessive trash on the day of your departure (charges available HERE).

5.2 These timings allow our cleaners to prepare our home ready for our next guests. Late departures, unless by prior arrangement will incur a charge ( available HERE) and these charges will in any case be deducted from your security bond.

6. Complaints

6.1 In the unlikely event that the client has any reason for complaint or dissatisfaction, they must contact the local Management Company caring for the property in Florida immediately so that remedial action may be taken. Details of how to contact the Management Company will be found in the accommodation.

7. Smoking

7.1 For the comfort and safety of clients and guests, smoking is not permitted in the home. Smokers may do so in the pool / patio area.

7.2 There will be an additional cleaning charge if the client and or guests choose to ignore this condition of booking. By law the property is hardwired with smoke detectors it is an offence to interfere or obstruct them.

8. Animals and Pets:

8.1 Animals and Pets are NOT permitted in the Home.  This condition is strictly enforced.
